These Terms and Conditions (“Terms”) govern your use of the services, website, and booking systems of 7th Element Medical Aesthetics, PLLC (“7th Element,” “the Practice,” “we,” “us,” or “our”), located at 4203 Montrose Blvd, Suite 400, Houston, TX 77006. By scheduling an appointment, visiting our website, or receiving services from us, you (“you,” “Client,” or “Patient”) agree to be bound by these Terms. If you do not agree, please do not use our services or website.
1. Nature of Services
7th Element provides medical aesthetic services, including but not limited to neurotoxin injections, dermal fillers, regenerative and peptide therapies, GLP-1 therapy, medical-grade chemical peels, LED light therapy, and dermal procedure work including lesion and DPN removal. All medical aesthetic procedures are performed by licensed and qualified medical professionals, including Princess K. Egland, DScPA, PA-C, operating under the medical direction and delegation protocols of Dr. Asim Merchant, MD, in accordance with applicable Texas Medical Board regulations.
Services offered are elective, cosmetic, and/or wellness-oriented in nature unless otherwise stated. Nothing on our website or in our marketing constitutes a guarantee of specific results, as individual outcomes vary based on anatomy, health history, skin condition, and other factors outside our control.
2. Consultation and Informed Consent
All new clients are required to complete an intake questionnaire and consultation prior to receiving treatment. Certain services require a separate, procedure-specific informed consent form to be reviewed and signed prior to treatment. Treatment will not be administered without completed intake and consent documentation. You are responsible for providing accurate and complete health history information; withholding or misrepresenting medical information may affect your eligibility for treatment and releases the Practice from liability arising from undisclosed conditions.
3. Age Requirements
Clients must be at least 18 years of age to receive services independently. Where a treatment is medically appropriate for a minor and permitted under Texas law, services may only be provided with the written consent of a parent or legal guardian, who must also be present at the time of consultation and treatment.
4. Appointments and Booking
Appointments may be scheduled through our website, by phone, or through our HIPAA-compliant electronic health record and booking platform. When you book through our online scheduling system, you are directed to a secure third-party platform used solely to manage appointment scheduling and protected health information; the services booked and offered remain those of 7th Element Medical Aesthetics, PLLC.
- A valid form of payment or deposit may be required to reserve certain appointments.
- Please arrive on time; late arrivals may result in a shortened appointment or the need to reschedule at our discretion.
- We reserve the right to decline or discontinue services to any individual for medical, safety, or conduct-related reasons.
5. Cancellation and No-Show Policy
We require at least 24 hours’ notice to cancel or reschedule an appointment. Cancellations made with less than 24 hours’ notice, or failure to appear for a scheduled appointment, may result in forfeiture of any deposit paid and/or a cancellation fee. Repeated no-shows or late cancellations may result in a requirement to prepay for future appointments.
6. Payment, Pricing, and Packages
Current pricing for services is available on our website and may be updated at our discretion; the price in effect at the time of your appointment applies. Payment is due at the time services are rendered unless other arrangements have been made in writing. Membership, package, and series pricing (including any promotional or founding-client pricing) is subject to the specific terms disclosed at the time of purchase, including any applicable expiration periods.
7. Refund Policy
Because our services are personalized medical procedures performed at the time of your appointment, all sales of rendered services are final and non-refundable. Unused prepaid packages, memberships, or product purchases may be eligible for a partial refund or credit at our sole discretion and in accordance with the specific package or membership terms provided at purchase. Product sales are subject to our product return policy, available upon request.
8. Assumption of Risk
You acknowledge that all medical aesthetic procedures carry inherent risks, including but not limited to bruising, swelling, asymmetry, allergic reaction, infection, or unsatisfactory results, and that no specific outcome is guaranteed. By electing to receive treatment, you voluntarily assume these risks after being given the opportunity to ask questions and review the applicable informed consent documentation.
9. Photography, Testimonials, and Marketing
With your separate written consent, we may photograph or record your treatment for clinical documentation, before-and-after comparison, or marketing purposes. You are never required to consent to marketing use of your images as a condition of receiving treatment, and you may withdraw previously granted marketing consent at any time by contacting us in writing.
10. Privacy and Protected Health Information
Our collection, use, and protection of your personal and health information is governed by our Privacy Policy and, where applicable, our HIPAA Notice of Privacy Practices, both available upon request or on our website. By using our services, you consent to the collection and use of information as described in those documents.
11. Website Use
All content on our website, including text, images, logos, and branding (including “7th Element Medical Aesthetics” and “The Face Architect”), is the property of 7th Element Medical Aesthetics, PLLC and may not be copied, reproduced, or used without our prior written consent. Our website is provided for informational purposes and does not constitute medical advice or create a provider-patient relationship until an appointment is booked and a consultation completed.
12. Limitation of Liability
To the fullest extent permitted by Texas law, 7th Element Medical Aesthetics, PLLC, its owners, medical director, employees, and contractors shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services or website, except to the extent such liability arises from our negligence or willful misconduct as determined under applicable law. Nothing in these Terms limits any right or remedy that cannot be waived under Texas law.
13. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. The effective date at the top of this page reflects the most recent revision. Continued use of our services or website after changes are posted constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Harris County, Texas.
